so on my bday (8/30) i got an ipod touch. a week later the new one came out. so i want to trade in my 1st gen for the 2nd gen, because the new one has a built-in speaker, and those lousy earbuds are so annoying. what excuse can i make to the Apple Store to trade in my 1st gen for the new one?

I dont think you can do anything about it. Maybe if you have a year warranty or something, try returning it and exchange it for the newer one. Just pay the difference like what LP said.

Dude, you can totally return it if you go in person and be polite and friendly. I had bought an iPod Photo, and one month later the iPod Video came out.
I went in there, talk to the cashier, told them I had just bought the iPod Photo a month prior, and if I can get the new iPod Video. Dude was really nice, and said sure... Just paid the restocking fee of 30 bucks or whatever, and away I went with my brand new iPod.
However, I'm not sure if they've changed policies since then, but it's worth a try.
Just be sure to have your receipt ready and find the Apple employee with the biggest smile. Good luck!
